Terms and Conditions

These Terms and Conditions (“Agreement”) govern the services provided by TRL Upscale Transportation (“Company,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”). By booking and using our services, you acknowledge and agree to the following terms:

1. Client Responsibilities

The Client agrees to:

– Provide accurate information regarding pickup and drop-off locations, schedules, and any special requirements.
– Notify TRL Upscale Transportation of any changes to the service agreement in a timely manner.
– Maintain the cleanliness and condition of the vehicle to a reasonable standard throughout the duration of service.
– Ensure that no damage, misuse, or excessive dirtiness occurs to the vehicle during transportation.  

1.1 Pickup and Drop-Off Conditions

– Due to traffic regulations, safety concerns, and logistical constraints, the Company may not be able to wait on the street for pickups.
– We reserve the right to determine a designated pickup area to ensure operational efficiency and minimize disruption.

2. Biological Contamination Policy

– If a passenger contaminates the vehicle with bodily fluids due to negligence or misconduct, the Client is responsible for the cost of cleaning and restoring the vehicle to its original condition.
– The Client must notify the Company immediately of any contamination incidents and take appropriate action to mitigate the impact on other passengers and the vehicle.
2.1 Cleaning Fee
– A $500 cleaning fee will be charged for any vomiting or other bodily fluid contamination.
– The fee must be paid within seven (7) days of receiving an invoice.
– Failure to pay within the specified period may result in additional charges and could impact future bookings.

3. Payment Terms

– A non-refundable deposit of 20% of the total booking amount is required at the time of booking.
– The remaining balance is due no later than seven (7) days before the scheduled pickup.
– Failure to pay the remaining balance on time may result in cancellation without a refund of the deposit.

– In the event that the reservation exceeds the agreed upon time,  additional charges will apply.  Per additional hour, with no partial increments. A grace period of fifteen minutes shall be permitted beyond the scheduled end time.  Payment is due at the end of the event. By making the deposit payment, The Client acknowledges and accepts these terms and conditions.

3.1 Last-Minute Booking Policy

– Bookings made within seven (7) days of the scheduled pickup must be paid in full at the time of booking.
– Cancellations made prior to 48 hours of the scheduled pickup will incur a non-refundable deposit of 20% of the total booking amount.

4. Cancellation and Refund Policy

4.1 Cancellation by the Client

– Clients must provide written cancellation notice to TRL Upscale Transportation at [admin@trlupscaletransport.com]  at least 48 hours  before the scheduled pickup time.

– Cancellations made within 48 hours of the scheduled pickup will incur a 50% cancellation fee of the total booking cost.

– Cancellations made less than 48 hours before the scheduled pickup time may be subject to the full fare charge.

4.2 Waiver of Cancellation Fees
– TRL Upscale Transportation may, at its sole discretion, waive cancellation fees in cases of extenuating circumstances such as acts of God, medical emergencies, or other unavoidable situations.
4.3 Refunds

– Refunds for cancellations made within the 48-hour notice period will be processed in accordance with TRL Upscale Transportation’s refund policy, minus applicable cancellation fees.

5. Illegal Substance Policy

– If a driver suspects the presence of illegal substances in the vehicle, they are required to:

– Immediately terminate the journey and pull over to a safe location.

– Contact law enforcement and request a canine search of the vehicle.

– Any individuals found in possession of illegal substances will be subject to prosecution in accordance with the law.

6. Liability and Indemnification

– TRL Upscale Transportation is not liable for delays or service interruptions caused by circumstances beyond our control, including but not limited to traffic conditions, weather events, road closures, or mechanical issues.

– In the event that the reservation period is extended due to unforseen delays, the Client shall be responsible for additional time incurred. Additional charges shall apply at the standard hourly rate for each hour of extended service; partial hour increments will not be prorated. A grace period of fifteen minutes beyond the scheduled end time is permitted. Thereafter, additional time will be billed in full-hour increments.

– The Client assumes full responsibility for any damage caused to the vehicle by themselves or their passengers.

– TRL Upscale Transportation is not responsible for lost, stolen, or damaged personal items left in the vehicle.

7. Conduct and Safety

The Client and all passengers must:

– Follow all the instructions provided by the driver.

– Wear seat belts where required by law.

– Refrain from disruptive, disorderly, or illegal behavior.

– Smoking (including vaping) and the use of illegal substances in the vehicle are strictly prohibited.

8. Media Release Agreement:

By booking a service with TRL Upscale Transportation, you grant permission for photos or videos taken during your transportation experience to be used for promotional purposes, including but not limited to our website, social media, and marketing materials. If you prefer not to be included, please notify us in writing before your scheduled service.

TRL Upscale Transportation reserves the right to terminate service immediately if passengers engage in inappropriate behavior, without a refund.

9. Changes to Terms and Conditions

TRL Upscale Transportation reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.
